1. Overview and Acceptance

These Terms of Service (“Terms”) govern access to and use of capricornusliving.com, including related content, features, products, and services (collectively, the “Services”). The Services are operated by Capricornus Living and powered by Shopify.

By accessing the Services or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, do not use the Services.

2. Eligibility and Accounts

You must be at least the age of majority in your place of residence, or use the Services with the permission of a parent or legal guardian. Information you provide must be accurate, current, and complete. You are responsible for maintaining the confidentiality of account credentials and for activity carried out through your account.

3. Products and Natural Materials

We aim to describe and photograph products accurately. Screen settings, lighting, and the natural character of fur, leather, suede, shearling, and other materials may cause variations in color, grain, texture, hair direction, or density. Measurements are approximate unless expressly guaranteed. Such reasonable natural variation does not mean that an item is defective.

Product descriptions, availability, specifications, and pricing may be corrected or updated without notice. We may discontinue products or limit quantities where reasonably necessary.

4. Orders

Submitting an order is an offer to purchase. An order is accepted when we send confirmation that it has been accepted or fulfilled. We may decline, limit, hold, or cancel an order for legitimate reasons, including stock errors, pricing errors, payment problems, suspected fraud, delivery restrictions, or violation of these Terms. If a paid order is cancelled by us, the affected amount will be refunded.

Please review product selection, size, color, quantity, and delivery details before ordering. Change or cancellation requests are not guaranteed after processing begins.

5. Prices, Payment, and Taxes

Store prices are displayed in USD unless the storefront or checkout clearly shows another currency. The amount charged is the amount confirmed at checkout, subject to correction of an obvious error before acceptance. Shipping charges, taxes, duties, and other applicable charges are shown or described at checkout where available.

You represent that you are authorized to use the selected payment method and that billing information is accurate. Payments are processed by Shopify and authorized payment providers under their applicable terms.

6. Shipping and Delivery

Processing and delivery estimates are described in our Shipping Policy. Delivery dates are estimates unless expressly stated otherwise. Carrier delays, customs procedures, weather, peak demand, and events outside our reasonable control may affect delivery. Mandatory consumer rights concerning delivery and risk of loss remain unaffected.

7. Returns, Refunds, and Exchanges

Returns, refunds, exchanges, and cancellations are governed by our Refund Policy. Returns require prior authorization. We do not publish a universal return address; instructions and the appropriate destination are provided after an eligible request is approved.

8. Promotions and Gift Cards

Discounts, promotions, and gift cards may have additional terms. Unless stated otherwise, discounts cannot be combined, applied retroactively, redeemed for cash, or used outside their validity period. If promotion-specific terms conflict with these Terms, the promotion-specific terms control for that promotion.

9. Intellectual Property

The Services and their content—including the Capricornus Living name, branding, text, product presentation, photographs, graphics, video, design, and arrangement—are owned by or licensed to Capricornus Living and protected by applicable intellectual-property laws. You may use the Services only for personal, non-commercial shopping purposes. No content may be copied, reproduced, republished, distributed, modified, sold, scraped, or commercially exploited without prior written permission, except where applicable law expressly permits.

10. Reviews, Feedback, and Submitted Content

If you submit a review, photograph, comment, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not violate another person’s rights. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with operating and promoting the Services. We may moderate or remove content that violates these Terms.

11. Prohibited Conduct

You may not use the Services to violate law or third-party rights; submit fraudulent, harmful, misleading, infringing, or malicious material; interfere with security or operation; gain unauthorized access; transmit malware; collect other users’ information without authorization; or use automated systems in a way that places an unreasonable load on, circumvents, or damages the Services.

12. Third-Party Services and Links

The Services may rely on or link to third-party services, including Shopify, payment providers, carriers, social platforms, and analytics services. Third-party services are governed by their own terms and policies. We are not responsible for external websites or services that we do not control.

13. Relationship with Shopify

Shopify provides the commerce platform that enables the Services. Purchases from this store are transactions with Capricornus Living, not with Shopify. To the extent permitted by law, Shopify is not responsible for the products, fulfillment, customer service, or disputes arising from purchases made through this store.

14. Privacy

Our collection and use of personal information are described in our Privacy Policy. Shopify may separately process information as described in the Shopify Consumer Privacy Policy.

15. Disclaimer

Except for express promises stated on the Services and rights that cannot legally be excluded, the Services and products are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted or error-free. Implied warranties are excluded only to the extent permitted by applicable law.

16. Limitation of Liability

To the fullest extent permitted by law, Capricornus Living and its service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Services. Where liability cannot be excluded, it will be limited only to the extent allowed by law. Nothing in these Terms excludes liability or consumer remedies that cannot legally be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to indemnify Capricornus Living against third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights.

18. Severability, Waiver, and Assignment

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent; we may transfer them as part of a legitimate business reorganization, sale, or service arrangement, subject to applicable law.

19. Governing Law and Disputes

These Terms are governed by applicable law, without depriving consumers of mandatory protections in their place of residence. Disputes will be handled by courts or other forums having lawful jurisdiction. Before filing a formal claim, please contact us so that we can try to resolve the matter.

20. Changes and Contact

We may update these Terms by posting a revised version on this page. Material changes will take effect as stated in the notice and as permitted by law. Continued use after the effective date means you accept the revised Terms.
